| The Michigan Legislature adopted P.A. 33 of 2008 (being the
Michigan Planning Enabling Act, M.C.L. 125.3801 et seq.). Governor
Jennifer Granholm signed it into law on March 13, 2008. The statute takes
effect September 1, 2008. The Michigan Legislature adopted P.A. 12 of 2008 which is corrective and technical amendments to the Michigan Zoning Enabling Act, M.C.L. 125.3101 et seq.). Governor Jennifer Granholm signed it into law on February 29, 2008. The amendments took effect February 29, 2008. |

The Michigan Planning Enabling Act replaces the three existing planning enabling acts in Michigan:
These acts impact every single planning commission in the state of Michigan. It will require review of the ordinance or resolution which created the planning commission in the first place, with nearly all such ordinances needing to be amended or replaced. Resolutions creating a planning commission should be replaced with an ordinance. Also the bylaws for the planning commission are likely to need to be amended or a new set of bylaws adopted. |

The Michigan Planning Enabling Act will take effect September 1, 2008. Starting on that date planning commissions will need to be following this new act. See the list of handouts, below, for more information. Also review the frequently asked questions on the new act. Training programs on both the new Michigan Planning Enabling Act and the amendments to the Michigan Zoning Enabling Act are scheduled for May and June 2008 at many locations all over Michigan. |
